IHSS denying overtime benefits to in-home health service workers
I read in today’s paper that the state of California, which employs over 400,000 people throughout the state as in-home health services workers, has refused to provide overtime pay for in-home healthcare services workers.
I find that interesting in that I represent an in-home health services worker who has a workers’ compensation claim who has a workers’ compensation claim for having suffered an injury while providing services to the in-home services recipient. My client, was accompanying the in-home health recipient to the bank.
In-home health services has denied the claim arguing that taking someone to the bank, though notable, was not within the course and scope of the in-home health services contract. I disagree! And the courts may have to decide this issue. As this is a newer claim, you will have to stay posted to see how it turns out.
